Liability & Rental Agreement

Agreement Terms:

This agreement constitutes the entire understanding between San Flea Beach Service LLC (the lessor) and the lessee and may only be modified by written consent from both parties. By signing this agreement, the lessee confirms they are at least eighteen (18) years old and not under any legal disability that would hinder entering into this agreement. The lessee agrees not to transfer or assign this lease or the rented equipment without prior written consent from San Flea Beach Service LLC. Additionally, any damages or loss incurred during the rental period must be reported promptly to San Flea Beach Service LLC. Failure to report damages or loss may result in additional charges.

Acknowledgment of Responsibility:

The lessee acknowledges and accepts full responsibility for the safe and proper use of the beach rental equipment provided by San Flea Beach Service LLC, understanding and accepting all associated risks.

Responsibility for Equipment:

During the rental period, the lessee bares full responsibility for the care and condition of the equipment. The lessee commits to returning the equipment in the same condition as it was at the commencement of the lease, allowing for reasonable wear and tear consistent with responsible use. Loss, theft, or damage to the rented property is solely the lessee's liability. Replacement costs for lost or irreparably damaged items shall be borne by the lessee. Repair costs for damaged equipment will also be the lessee's responsibility upon return, and rental charges will not offset such costs.

Equipment Inspection and Usage Guidelines:

Before usage, it is the lessee's responsibility to thoroughly inspect the equipment to ensure its suitability and condition for the intended purpose. If damage is noted upon inspection by lessee, they shall immediately contact San Flea beach service LLC. Lessees must adhere to all safety guidelines provided and use the equipment strictly in accordance with its designated use. San Flea Beach Service LLC prohibits the use of rented equipment for activities or purposes not expressly approved by the company, including commercial use, improper assembly or disassembly, and use by unauthorized individuals.

Indemnification:

The lessee agrees to indemnify and hold San Flea Beach Service LLC harmless from any claims, damages, or legal proceedings arising from their use or possession of the equipment. Rental charges commence upon the equipment's departure from San Flea Beach Service LLC premises and continue until its safe return.

Safety Guidelines:

Lessees are encouraged to adhere to all safety guidelines and use caution while utilizing the rental equipment. This includes properly setting up and securing chairs and umbrellas to prevent injury or damage.

Property Rights and Conduct:

All rental equipment remains the property of San Flea Beach Service LLC throughout the rental period. Lessees do not have the right to sell, transfer, or modify the equipment in any way. Lessees are expected to conduct themselves in a respectful and responsible manner while using the rental equipment and within the rental premises. This includes complying with all applicable laws and regulations. San Flea Beach Service LLC reserves the right to terminate the rental agreement and reclaim the equipment in the event of misconduct or misuse by the lessee.

Environmental Stewardship:

San Flea Beach Service LLC values environmental stewardship and encourages lessees to practice responsible environmental practices while using the rental equipment. This includes proper waste disposal and conservation of natural resources. San Flea Beach Service LLC appreciates the cooperation of lessees in maintaining the beauty of natural surroundings.
